By creating an account and using Scoutcast, you agree to be legally bound by these Terms of Service. If you do not agree, you may not use the Platform.
1. Acceptance of Terms
By accessing or using Scoutcast (“the Platform,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and Scoutcast (PTY) LTD, a South African company (Registration Number: 2026/040587/07).
By creating an account, you confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into this agreement
- All information you provide is accurate and truthful
- You will comply with all applicable laws and regulations
- You have read and understood our Privacy Policy
2. Platform Description
Scoutcast is a professional networking and marketplace platform connecting entertainment and creative industry professionals, including but not limited to:
- Talent: Actors, models, presenters, voice artists, musicians
- Crew: Camera operators, lighting technicians, sound engineers, makeup artists, hair stylists
- Creative professionals: Directors, DPs, editors, photographers, designers
- Service providers: Locations, vehicles, equipment rental, props, studios
- Agencies: Talent agencies, model management, casting agencies
- Influencers and content creators
What Scoutcast IS:
- A platform to discover and connect with industry professionals
- A portfolio hosting and showcase service
- A communication and collaboration tool
- A scheduling and project management system
- A community for industry networking
What Scoutcast IS NOT:
- An employer or employment agency
- A talent agency or booking agent
- A payment processor or escrow service
- A guarantor of work quality, payment, or job outcomes
- A party to contracts between users
- Responsible for disputes, agreements, or transactions between users
3. User Accounts & Registration
3.1 Account Creation
To use Scoutcast, you must create an account by providing accurate, complete, and current information. You agree to:
- Provide your real name and accurate contact information
- Provide your true date of birth (you must be 18+)
- Create a secure password and maintain its confidentiality
- Notify us immediately of any unauthorized access to your account
- Take responsibility for all activities under your account
3.2 Account Security
You are solely responsible for maintaining the security of your account. Scoutcast is not liable for losses resulting from unauthorized use of your account, whether with or without your knowledge.
3.3 One Account Per Person
You may only create and maintain ONE personal account. Creating multiple accounts (duplicate profiles, fake accounts, impersonation accounts) is prohibited and grounds for immediate termination.
4. Age Requirements & Verification
CRITICAL: SCOUTCAST IS AN 18+ PLATFORM ONLY
4.1 Minimum Age
You must be at least 18 years of age to create an account or use Scoutcast. By checking the age confirmation box during registration, you explicitly confirm that you are 18 years or older.
4.2 Age Verification
- Scoutcast may request additional age verification at any time
- Providing false age information is grounds for immediate permanent ban
- We reserve the right to terminate accounts where we suspect underage use
- Suspected underage accounts may be reported to authorities
4.3 Content Depicting Minors
Scoutcast recognises that minors may appear in legitimate professional content across the creative industries — including production stills, agency showreels, photojournalism, commercial campaigns, and film/TV productions. Content uploaded to Scoutcast may depict minors only where ALL of the following conditions are met:
- The content is professional in nature (e.g., production work, agency portfolios, editorial photography, news/documentary coverage)
- The uploader holds all necessary legal consents from the minor’s parent or legal guardian
- The content complies with all applicable child protection and child performance laws in the relevant jurisdiction (including the South African Children’s Act, US Coogan Law, UK child performance licensing, or equivalent)
- The content does not include the minor’s personal contact information, location, or any data that could be used to identify or contact them directly
- The content is not exploitative, sexualised, or harmful in any way
ZERO TOLERANCE: Exploitative, sexualised, or unlawful content depicting minors is STRICTLY PROHIBITED and will result in:
- Immediate permanent account termination
- Immediate content removal and evidence preservation
- Reporting to the South African Police Service (SAPS) and/or relevant international law enforcement
- Referral to the Films and Publications Board (FPB) where applicable
- Permanent ban from re-registering
CONTENT RESPONSIBILITY: By uploading any content depicting minors, you represent and warrant that:
- You hold valid, written consent from each minor’s parent or legal guardian
- All content complies with applicable child performance and labour laws
- No minor’s personally identifiable information is disclosed through the Platform
- You will indemnify and hold harmless Scoutcast from any claims arising from your breach of these warranties
4.4 Agency-Specific Requirements
If you register as an Agency (talent agency, model management, casting agency):
- All agency account holders must be 18 years or older
- Agencies may include professional portfolio content depicting minors they represent, provided they comply with Section 4.3 above
- Agencies are responsible for holding and maintaining written parental/guardian consent for any minor whose likeness appears in uploaded content
- Agencies must comply with all applicable child performance and labour laws in their jurisdiction
- Agencies assume full liability for the lawfulness and appropriateness of all content they upload
- Violations of content standards result in immediate account suspension and potential legal action
5. User Conduct & Prohibited Activities
5.1 You Agree To:
- Provide accurate and truthful information in your profile
- Treat other users with respect and professionalism
- Negotiate terms, rates, and contracts directly with other users
- Meet in safe, public locations for initial meetings
- Verify credentials and references of other users independently
- Report inappropriate behavior, scams, or policy violations promptly
- Use the Platform only for lawful purposes
- Respect intellectual property rights of others
5.2 Prohibited Activities — You Agree NOT To:
- Provide false age, identity, or credential information
- Upload content depicting minors except as permitted under Section 4.3 (professional content with appropriate consents)
- Upload any exploitative, sexualised, or unlawful content depicting minors
- Post illegal, defamatory, obscene, or sexually explicit content
- Harass, threaten, stalk, or abuse other users
- Discriminate based on race, gender, religion, nationality, disability, or sexual orientation
- Engage in spam, advertising, or unsolicited commercial messages
- Impersonate others or create fake/duplicate profiles
- Use automated systems (bots, scrapers) without written permission
- Attempt to gain unauthorized access to the Platform or user accounts
- Collect or harvest user data without permission
- Post malware, viruses, or harmful code
- Engage in fraud, scams, or illegal transactions
- Violate any applicable local, national, or international laws
6. Content Ownership & License
6.1 Your Content
You retain full ownership of all content you post on Scoutcast (photos, videos, text, portfolio items, posts). However, by uploading content, you grant Scoutcast:
- A worldwide, non-exclusive, royalty-free license to display your content on the Platform
- The right to store, reproduce, and distribute your content as necessary to provide the service
- The right to use your content for promotional purposes (with attribution) unless you opt out
- The right to create derivative works (thumbnails, compressed versions) for technical purposes
6.2 Content Responsibility
You are solely responsible for all content you post. You represent and warrant that:
- You own or have the necessary rights, licenses, and permissions for all content you upload
- Your content does not violate intellectual property rights of any third party
- Your content complies with all applicable laws and these Terms
- All individuals featured in your content have consented (or had lawful consent given on their behalf) to being featured, and any content depicting minors complies with Section 4.3
6.3 Content Removal
Scoutcast reserves the right to remove any content that:
- Violates these Terms or our Community Guidelines
- Infringes intellectual property rights
- Features minors in a manner that does not comply with Section 4.3
- Is flagged by multiple users as inappropriate
- Poses legal, safety, or reputation risks
6.4 Copyright Infringement
Scoutcast respects intellectual property rights. If you believe your copyrighted work has been used without permission, contact us at legal@scoutcast.app with:
- Description of the copyrighted work
- URL of the infringing content
- Your contact information and proof of ownership
- A statement of good faith belief that use is not authorized
7. Content Moderation & Community Standards
7.1 Content Review
Scoutcast employs content filtering, user reporting tools, and manual review processes to ensure content complies with these Terms and Community Guidelines.
7.2 Reporting System
Users can report content or behavior that violates these Terms. All reports are reviewed within 24–48 hours.
7.3 Appeals Process
If your content is removed or account is suspended, you may appeal the decision within 14 days by contacting support@scoutcast.app with:
- Your account email
- Reason for appeal
- Any supporting evidence
Appeals are reviewed within 7 business days. Final decisions are at Scoutcast’s sole discretion.
8. Subscription Tiers & Payments
8.1 Subscription Plans
Scoutcast offers the following subscription tiers:
- Free (R0/month): Basic profile, regional browsing, limited posting (2 Collab posts per month)
- Freelancer (R99/month): Regional posting, national viewing, unlimited Collab, project workspace
- Creator (R149/month): National posting, continental viewing, global Scout & Collab search access
- Professional (R299/month): International posting & viewing, unlimited posts with 14-day visibility, highlighted posts with boost, top of all search results
All prices are in South African Rand (ZAR). Multi-currency pricing (USD, GBP, EUR) is available and determined at the point of purchase.
8.2 Platform Availability & Geographic Expansion
IMPORTANT: Geographic reach refers to the areas where your content and profile can be viewed and posted — not a guarantee of user density or engagement in those regions.
Scoutcast is a growing platform. The geographic reach features of each subscription tier operate as follows:
- “Regional,” “National,” “Continental,” and “International” describe the accessibility scope of your content and profile — the geographic areas where your posts, portfolio, and profile are eligible to be discovered.
- Community size and active user density in any given city, country, or region varies and is not guaranteed. As a growing platform, some areas will have fewer active users than others.
- Higher-tier subscribers benefit regardless of community density through: priority placement in search results, unlimited posting, extended post visibility, highlighted and boosted content, and early-mover positioning in newly active regions.
- Geographic reach expands as the Scoutcast community grows. We are committed to expanding our user base, but we do not guarantee specific user numbers in any region.
By subscribing to any paid tier, you acknowledge that you understand the distinction between content accessibility and guaranteed audience, and that your subscription provides the features described in Section 8.1 regardless of community size in your target regions.
8.3 Billing & Payment Processing
- Subscriptions are billed monthly through Apple In-App Purchase (iOS) or Google Play Billing (Android)
- Scoutcast does not directly handle or store payment card information — all billing is managed by Apple or Google
- Subscriptions renew automatically unless cancelled before the renewal date
- Prices are subject to change with 30 days’ notice
8.4 Cancellation & Refunds
- You may cancel your subscription at any time via your device’s App Store or Google Play subscription settings
- Cancellation takes effect at the end of the current billing period
- No refunds for partial months or unused time
- Refund requests for technical issues are handled by Apple or Google per their respective policies
- Promo codes and discounts are non-transferable and non-refundable
9. User Interactions & Transactions
IMPORTANT DISCLAIMER: Scoutcast facilitates connections but is NOT a party to any agreements, contracts, or transactions between users.
9.1 User Responsibility
All interactions, negotiations, contracts, and payments between users are solely between those users. You are responsible for:
- Verifying credentials, references, and portfolios of other users
- Negotiating rates, terms, and deliverables
- Creating written contracts (recommended for all paid work)
- Handling payments directly (Scoutcast does not process payments between users)
- Resolving disputes independently
- Meeting safety precautions (meeting in public, informing others of your location)
9.2 Disputes
Scoutcast is not responsible for disputes between users, including but not limited to:
- Non-payment or payment disputes
- Work quality or deliverable disputes
- Contract breaches
- Miscommunication or misunderstandings
- Safety incidents or personal conflicts
9.3 Safety Recommendations
- Always meet in public locations for initial meetings
- Inform friends/family of meeting locations and times
- Trust your instincts — if something feels wrong, disengage
- Never share sensitive financial information
- Use written contracts for all paid work
- Report suspicious behavior immediately
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY SOUTH AFRICAN LAW:
10.1 Platform “AS IS”
Scoutcast is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of uninterrupted or error-free service
- Warranties regarding accuracy, reliability, or completeness of content
- Warranties that the Platform is free from viruses or harmful components
- Warranties regarding user density, community size, or engagement levels in any geographic region
10.2 Scoutcast Is NOT Liable For:
- Interactions, agreements, or disputes between users
- Content posted by users (including inaccurate, defamatory, or harmful content)
- Loss of data, revenue, profits, or opportunities
- Job outcomes, payment issues, or work quality
- Service interruptions, errors, or technical issues
- Actions or omissions of third parties (payment processors, hosting providers)
- Damages arising from unauthorized access to your account
- Personal injury, property damage, or safety incidents related to user interactions
- The number or activity level of users in any geographic region, category, or profession
10.3 Limitation of Damages
In no event shall Scoutcast’s total liability to you for all claims exceed the greater of:
- R1,000 (One Thousand South African Rand), OR
- The amount you paid to Scoutcast in the 12 months prior to the claim
10.4 Exclusion of Consequential Damages
Scoutcast shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or reputation, even if advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless Scoutcast (PTY) LTD, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:
- Your use or misuse of the Platform
- Your violation of these Terms
- Your violation of any laws or third-party rights
- Content you post on the Platform
- Your interactions, agreements, or disputes with other users
- Claims that content you posted infringes intellectual property rights
- Claims related to age verification or content featuring minors
12. Account Termination & Suspension
12.1 Termination by Scoutcast
Scoutcast may suspend or terminate your account IMMEDIATELY, without notice, if:
- You violate these Terms or Community Guidelines
- You provide false information (especially age verification)
- You upload exploitative, unlawful, or non-compliant content depicting minors (see Section 4.3)
- You engage in illegal activity, fraud, or scams
- We receive multiple user reports about your conduct
- Your account poses legal, safety, or reputation risks
- We are required to do so by law or court order
12.2 Termination by You
You may delete your account at any time via Settings → Account → Delete Account. Upon deletion:
- Your personal data will be removed within 30 days (POPIA compliance)
- Your profile and portfolio will be immediately deactivated
- Posted content may remain visible for up to 7 days during cache clearing
- You forfeit access to any unused subscription credits
- Messages sent to other users may remain visible (but anonymised as “Deleted User”)
12.3 Effect of Termination
Upon termination, all rights granted to you under these Terms immediately cease. Sections that by their nature should survive termination shall survive, including: Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution.
13. Dispute Resolution & Governing Law
13.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles.
13.2 Jurisdiction
You irrevocably consent to the exclusive jurisdiction of the courts located in Cape Town, Western Cape, South Africa for any disputes arising from these Terms or your use of Scoutcast.
13.3 Dispute Resolution Process
In the event of any dispute, claim, or controversy arising from these Terms:
- Good Faith Negotiation: Parties agree to first attempt to resolve the dispute through good faith negotiation (30 days).
- Mediation: If negotiation fails, parties agree to mediation under the rules of the Arbitration Foundation of Southern Africa (AFSA).
- Arbitration: If mediation fails, the dispute shall be resolved by binding arbitration under AFSA rules in Cape Town, South Africa. The arbitrator’s decision is final and binding.
13.4 Class Action Waiver
You agree to resolve disputes with Scoutcast on an individual basis. You waive any right to participate in class action lawsuits or class-wide arbitration.
14. Compliance with South African Laws
14.1 POPIA Compliance
Scoutcast complies with the Protection of Personal Information Act (POPIA), 2013. Our Privacy Policy details how we collect, use, store, and protect your personal information in accordance with POPIA requirements.
14.2 Electronic Communications and Transactions Act
By using Scoutcast, you consent to receive electronic communications from us, including notices, agreements, and disclosures. You agree that electronic communications satisfy any legal requirement for written communications.
14.3 Consumer Protection Act
If you are a consumer as defined by the Consumer Protection Act, 2008, you retain all rights granted under that Act, and nothing in these Terms limits those rights.
15. Changes to Terms
Scoutcast reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. We will notify users of material changes via:
- Email notification to registered email address
- In-app notification
- Banner notification on the Platform
Continued use of Scoutcast after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Platform and delete your account.
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Scoutcast and supersede all prior agreements or understandings.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16.3 Waiver
Failure by Scoutcast to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
16.4 Assignment
You may not assign or transfer these Terms or your account without Scoutcast’s prior written consent. Scoutcast may assign these Terms at any time without notice.
16.5 Third-Party Services
Scoutcast may integrate with or link to third-party services (Apple, Google, Supabase, Sentry). Your use of third-party services is subject to their terms and privacy policies. Scoutcast is not responsible for third-party services.

By checking the “I agree to the Terms of Service” checkbox during account registration, you acknowledge that:
- You have READ these Terms of Service in their entirety
- You UNDERSTAND the terms and obligations set forth
- You AGREE to be legally bound by these Terms
- You confirm you are 18 years of age or older
- You will only upload content depicting minors in compliance with Section 4.3 (professional context with appropriate consents)
- You accept all limitations of liability and dispute resolution provisions
- You understand that geographic reach features describe content accessibility, not guaranteed audience size
These Terms of Service are effective immediately upon account creation.
